I-9 compliance in 2026 looks nothing like it did two years ago. ICE issued more Notices of Inspection in the first half of 2025 than in all of 2024. The One Big Beautiful Bill Act added over $170 billion in enforcement funding and put 12,000 new ICE officers on the ground. A new data-sharing agreement between ICE and the IRS gives enforcement teams direct access to employer records. And in March 2026, ICE reclassified a range of I-9 errors as substantive violations, eliminating the 10-day cure window that employers used to rely on during audits.
